On 8th of September a process against comrades and friends will begin in Dresden. They are accused of building and taking part in a criminal organization under the legal paragraph §129. All in all ten people are accused, however the prosecutor has decided to split the "group" and now the first four of them stand trial. Lina is one those selected for the first "group". She was initially arrested last summer, released after a few days and arrested again in November. Since then she has been in preventative detention. It appears Lina will stay incarcerated for the duration of the trial. This strategy not only divides the constructed group of the accused, but also makes any discussion and discourse between the accused and those in solidarity difficult or even impossible.

All of them are accused of beating up Nazis in various different situations. Lina's case is unique in that she is made responsible for every attack on Nazis during the last years in which one of the nazis claimed that a woman took part in the offensive. Cops and the Justice system believe the Nazi testimonies. This narrative fits perfectly into their partriarchal world view, which sees it as extremely unusual for a female person to take part in counterviolence. Thus it must always be the same woman .

Repression and the §129

The repression strategy that the state is following is not new. Repression is a consequence of resistance to the ruling patriarchal, fascist, capitalist, authoritarian and violent system. The idea of constructing their own suitable umbrella organisation- in this case the "antifascists"- and often including any people they are interested in, is also well known. We have seen it in many §129 cases in Germany, but also in other countries; the Ley Mordaza law in Spain and anti-terror laws in Chile and Italy are just some examples. This is an attempt by the state to create a suitable organization in order to utilize more tools of investigation and monitoring with the result of higher more numerous charges against individuals. In this context being accused of an action planned and undertaken as part of a group also leads to more severe sentences than being investigated or charged as an individual. Individualization, isolation and distancing from individuals, groups, friends and comrades is the main goal and the message is clear: any kind of supposed connection, collectivity or individual initiative we may have which opposes the system is enough for the state to charge us with §129, regardless of whether they exist or not. In this particular case, the state is applying a newer interpretation of the law that allows it to group people together in a §129 simply because they share similar ideas or are follow a particular political ideology.

Since their constructed grouping is necessarily hierarchical, as this is the state's understanding of an organization, it therefore requires a leader. This means somebody will be declared to hold this role, and will thus carry the main juridical responsibility.

Lina is somehow presented as this so-called leader of the organization. However she was made the leader along with her boyfriend, who, in the eyes of the state, was responsible for her radicalization. By arresting her and prosecuting the accused under this paragraph, the state is trying to intimidate the movement.

One of the goals of those in power is to destroy any developing connections between the movement and other communities using a strategy in which they attempt to quash any budding radicalization in the struggles and divide people by forcing them to distance themselves from radical action. They play with the societal recognition of bourgeois anti-fascism and believe that they minimize the acceptance of the necessity of counter-violence with their guilty verdicts.

For us, it does not matter who the state considers a guilty. We fight this state and its institutions and we do not validate its notions of morality, guilt and justice. We stand in solidarity with the accused persons beyond personal relationships and affinities. At a time when the state aims to isolate us, we are here to build bridges of communication and comradeship.

We approve of the fact that nazis were attacked. Counterviolence is a necessary step to change society and it won't be judged by us in the legal framework of the system we are aiming to destroy. Defending the persecuted person in a framework of innocence and guilt is a trap we should not and will not fall into. Instead we are in solidarity with the accused, as they are affected by the repressive apparatus of the state.

In favour of militant Antifascism and beyond

This trial is not however only an attack on the persecuted people. It is also an attempt to de-legitimize self defense and militant antifasicm. When nazis and fascists attack and destroy communities or when there are nazi pogroms against immigrants, our stance is to defend ourselves against their violence and to prevent any attempt to legitimize fascist practices in any field of activity.

Nonviolence protects the state

Since violence carried out by the state, capital and the systemic mechanisms inside and outside their institutional frameworks exists in and/or characterizes our everyday lives, counter-violence is an inevitable and indispensable tool. Fascists cannot be educated, they cannot be persuaded not to vote NPD, AFD etc, and they are not misguided. They choose to serve and sustain a system based on discrimination and oppression, they choose to attack and for these reasons our self defense is necessary.

We do not use counter-violence in order to impose ourselves on people nor do we use it to dominate and destroy others. We are under a constant attack and we therefore defend ourselves and our communities, with a perspective that aims for emancipation, freedom, autonomy and equality. These moments are just a small answer to the violence we experience every day. There are moments when the oppressors feel afraid, as in those when the nazis were attacked in Thuringia and Saxony in the course of the last years.

For us it is important to develop every antagonistic reaction in a projectuality. In order not to let the attacks on Nazis degenerate into symbolic action, we must simultaneously attack the authoritarian bourgeois democracy, which while not only oppressive itself, provides the circumstances for fascism to grow. Either anti-fascism embeds itself in an anti-authoritarian perspective, or it is simply a ritual formality. Any path that does not aim towards radical subversion and self-determination is tragically doomed to fail, with resistance withering into democratic comformism and a slow and inescapable slide towards the ultimate loss of freedom.

Media/nazi/cops propaganda

It is important not to follow the narrative presented by by cops and media, who obviously work together and follow a common goal in creating a mood that will weaken the movement. The strategies they use, such as background articles, warrents and the comparison of us and nazis has a historical continuity in Germany. We are presented as extremists, with nazis on the other extreme of the spectrum and a responsible capitalist democracy in the middle as the only legitimate actor. This is particularly obvious in the comparisons made between Lina and Beate Zschäpe and the fact they share the same prison. The §129 and the targeting of so called criminal organizations serves their propaganda against any radical movement and attempts to scare people and give the impression of a strong omniscient state. This propaganda concerning the creation of criminal organizations is a state strategy and an attack on self organization, collectivity and relationships.

For Lina the media and cop propaganda also targets her gender. The fact that a woman is accused in this kind of crime serves the justice and media as a moment of polarization. They present her in a sexist way, with continual reference to her relationship to a man and confusion as to why a woman would take this path. We see that suspicious women are either masculinized or pathologized, with their actions being seen as the result of their temperament or an emotional defect. In yet another case we see how a woman is described in the media as a female seducer with all the associated attributes, and demonized by means of these. On the other hand, in the eyes of more leftist media she is pictured as an innocent "girl". This image is also detrimental to the group of accused and the movement. The woman is also in every case merely the girlfriend of somebody.
In the course of the whole controversy, we must strive to go deeper against the punitive system, which reproduces patriarchy in its pure form

On top of the mass media and state propaganda the Nazis are also using the opportunity of a divided public opinion regarding the case to make their own propaganda, as victims of the radical left movement. They invented various methods of publication to out the accused people and call for fascist counterattacks on us. They gained information from cops and used their closed and open propaganda channels to spread as many details as possible, specifically targeting the accused and those in their surroundings.

In the eyes of the state, the mainstream media and the cops we are criminals and enemies, because of our ideas of freedom and our practices in fighting the system. We should not follow their definitions, but stand together against their repression.

Conclusion

But what would state repression be without its functionaries? For now the case is in the hands of the Federal Public Prosecutor, a political institution and choice which reveals the political extensions and implications of this trial. For this reason we have nothing to expect from the procedure in the court room. An emancipatory fight should be given in the streets, by creating pressure and political cost for their decisions. While the state creates charges and constructs relationships in order to fight antifascism, our place is on the streets, where we must attempt to break isolation and fear by creating new relationships and connections. This is the place where we can truly fight this repression and socially legitimize our struggles.

Repression is part of our struggle and we have to face it together. In a system where the problems demand to be solved in a personal way, we propose collective solutions. For this reason we call everyone to show their solidarity with the accused, and so their presence on the first day of the court procedure on the 8th of September in Dresden. Lets stand together and show that an attack on one of us is an attack on all of us. We are here, in solidarity with the accused people, against repression, and in support of militant antifascism which goes beyond attacking nazis and infiltrates the system with our ideas of liberty, non-hierarchy and mutual self organization.

Sommige van onze kameraden zullen hun proces hebben op 8 september maar het betreft ons allen .

Op 8 september begint in Dresden een proces tegen kameraden en vrienden. Zij worden beschuldigd van het oprichten van en deelnemen aan een criminele organisatie onder de wettelijke paragraaf §129. In totaal worden tien mensen beschuldigd, maar de openbare aanklager heeft besloten de "groep" op te splitsen en nu staan de eerste vier van hen terecht. Lina is een van de geselecteerden voor de eerste "groep". Zij werd vorige zomer voor het eerst gearresteerd, na een paar dagen vrijgelaten en in november opnieuw gearresteerd. Sindsdien zit zij in preventieve hechtenis. Het ziet ernaar uit dat Lina voor de duur van het proces in de gevangenis zal blijven. Deze strategie verdeelt niet alleen de samengestelde groep van beschuldigden, maar maakt ook elke discussie en discours tussen de beschuldigden en hen die solidair zijn moeilijk of zelfs onmogelijk.
Zij worden allen beschuldigd van het in elkaar slaan van nazi's in verschillende situaties. Lina's geval is uniek in die zin dat zij verantwoordelijk wordt gesteld voor elke aanslag op nazi's gedurende de laatste jaren waarbij een van de nazi's beweerde dat een vrouw aan het offensief had deelgenomen. Agenten en justitie geloven de getuigenissen van de nazi's. Dit verhaal past perfect in hun partriarchale wereldbeeld omdat het als uiterst ongewoon beschouwt dat een vrouw deelneemt aan tegengeweld. Het moet dus altijd dezelfde vrouw zijn.

Repressie en de §129

De repressiestrategie die de staat volgt is niet nieuw. Repressie is een gevolg van verzet tegen het heersende patriarchale, fascistische, kapitalistische, autoritaire en gewelddadige systeem. Het idee om een eigen geschikte overkoepelende organisatie op te zetten - in dit geval de "antifascisten" - en daar vaak alle mensen in op te nemen die hen interesseren, is ook bekend. Wij hebben dit gezien in vele §129-zaken in Duitsland, maar ook in andere landen; de Ley Mordaza-wet in Spanje en antiterreurwetten in Chili en Italië zijn slechts enkele voorbeelden. Dit is een poging van de staat om een geschikte organisatie te creëren ten einde meer onderzoeks- en controle-instrumenten te kunnen gebruiken met als resultaat een groter aantal aanklachten tegen personen. In deze context leidt beschuldiging van een actie die gepland en ondernomen is als deel van een groep ook tot zwaardere straffen dan onderzoek of beschuldiging als individu. Individualisering, isolatie en distantiëring van individuen, groepen, vrienden en kameraden is het hoofddoel en de boodschap is duidelijk: elke vermeende band, collectiviteit of individueel initiatief dat we hebben en dat zich verzet tegen het systeem is genoeg voor de staat om ons aan te klagen voor §129, ongeacht of ze bestaan of niet. In dit specifieke geval past de staat een nieuwere interpretatie van de wet toe die hem in staat stelt mensen te groeperen in een §129 eenvoudigweg omdat zij gelijkaardige ideeën delen of een bepaalde politieke ideologie aanhangen.
Aangezien hun geconstrueerde groepering noodzakelijkerwijs hiërarchisch is, omdat dit de opvatting van de staat is over een organisatie, is er dus een leider nodig. Dit betekent dat iemand wordt aangewezen om deze rol te vervullen, en dus de belangrijkste juridische verantwoordelijkheid draagt. Lina wordt op de een of andere manier voorgesteld als deze zogenaamde leider van de organisatie. Zij werd echter leider gemaakt samen met haar vriend, die in de ogen van de staat verantwoordelijk was voor haar radicalisering. Door haar te arresteren en de beklaagden op grond van deze paragraaf te vervolgen, probeert de staat de beweging te intimideren.

Een van de doelen van de machthebbers is om alle zich ontwikkelende verbindingen tussen de beweging en andere gemeenschappen te vernietigen met behulp van een strategie waarin zij proberen elke ontluikende radicalisering in de strijd de kop in te drukken en mensen te verdelen door hen te dwingen afstand te nemen van radicale actie. Zij spelen met de maatschappelijke erkenning van het burgerlijk antifascisme en menen dat zij met hun schuldige uitspraken de aanvaarding van de noodzaak van tegengeweld minimaliseren.

Voor ons maakt het niet uit wie door de staat als schuldig wordt beschouwd. Wij bestrijden deze staat en zijn instellingen omdat we het oneens zijn met de opvattingen over moraal, schuld en gerechtigheid. Wij zijn solidair met de beschuldigden, los van persoonlijke relaties en affiniteiten. In een tijd waarin de staat ons wil isoleren, zijn wij hier om bruggen te slaan voor communicatie en kameraadschap.

Wij keuren het goed dat nazi's werden aangevallen. Tegengeweld is een noodzakelijke stap om de maatschappij te veranderen en het zal door ons niet veroordeeld worden in het wettelijk kader van het systeem dat we willen vernietigen. Het verdedigen van de vervolgde in een kader van onschuld en schuld is een val waar we niet in moeten en zullen trappen. In plaats daarvan zijn we solidair met de beschuldigden, zoals zij getroffen worden door het repressieve apparaat van de staat.

Voor een militant antifascisme en verder

Dit proces is echter niet alleen een aanval op de aangeklaagden. Het is ook een poging om zelfverdediging en militant antifascisme te de-legitimeren. Wanneer nazi's en fascisten gemeenschappen aanvallen en vernietigen of wanneer er nazi-pogroms tegen immigranten zijn, is ons standpunt ons te verdedigen tegen hun geweld en elke poging tot legitimering van fascistische praktijken op welk gebied dan ook te voorkomen.

Geweldloosheid beschermt de staat

Aangezien geweld dat wordt uitgevoerd door de staat, het kapitaal en de systemische mechanismen binnen en buiten hun institutionele kaders bestaat in en/of kenmerkend is voor ons dagelijks leven, is tegengeweld een onvermijdelijk en onmisbaar instrument. Fascisten kunnen niet worden opgevoed, ze kunnen niet worden overgehaald om niet NPD, AFD enz. te stemmen, en ze zijn niet misleid. Zij kiezen ervoor om een systeem te dienen en in stand te houden dat gebaseerd is op discriminatie en onderdrukking, zij kiezen ervoor om aan te vallen en om deze redenen is onze zelfverdediging noodzakelijk.

Wij gebruiken geen tegengeweld om onszelf aan mensen op te dringen, noch gebruiken wij het om anderen te domineren en te vernietigen. We worden voortdurend aangevallen en daarom verdedigen we onszelf en onze gemeenschappen, met een perspectief dat gericht is op emancipatie, vrijheid, autonomie en gelijkheid. Deze momenten zijn slechts een klein antwoord op het geweld dat we elke dag ervaren. Er zijn momenten waarop de onderdrukkers bang zijn, zoals bij de aanval op de nazi's in Thüringen en Saksen in de loop van de laatste jaren.

Voor ons is het belangrijk om elke antagonistische reactie in een projectualiteit te ontwikkelen. Om de aanvallen op de nazi's niet te laten ontaarden in symbolische actie, moeten we tegelijkertijd de autoritaire burgerlijke democratie aanvallen, die niet alleen zelf onderdrukkend is, maar ook de omstandigheden verschaft waarin het fascisme kan groeien. Ofwel past het antifascisme in een antiautoritair perspectief, ofwel is het niet meer dan een rituele formaliteit. Elke weg die niet gericht is op radicale subversie en zelfbeschikking is tragisch genoeg gedoemd te mislukken, waarbij het verzet verwordt tot democratisch conformisme en een langzame en onontkoombare afglijding naar het uiteindelijke verlies van vrijheid.

Media/nazi/politie propaganda

Het is belangrijk om niet het verhaal te volgen van de politie en de media, die duidelijk samenwerken en een gemeenschappelijk doel hebben om een stemming te creëren die de beweging zal verzwakken. De strategieën die ze gebruiken, zoals achtergrondartikelen, arrestatiebevelen en de vergelijking van ons met nazi's heeft een historische continuïteit in Duitsland. Wij worden voorgesteld als extremisten, met nazi's aan het andere uiterste van het spectrum en een verantwoordelijke kapitalistische democratie in het midden als de enige legitieme actor. Dit blijkt met name duidelijk uit de vergelijkingen tussen Lina en Beate Zschäpe en het feit dat zij dezelfde gevangenis delen. De §129 en de gerichtheid op zogenaamde criminele organisaties dient hun propaganda tegen elke radicale beweging en poogt de mensen bang te maken en de indruk te wekken van een sterke alwetende staat. Deze propaganda over de oprichting van criminele organisaties is een staatsstrategie en een aanval op zelforganisatie, collectiviteit en relaties.

Voor Lina is de media- en politiepropaganda ook gericht op haar geslacht. Het feit dat een vrouw wordt beschuldigd van dit soort misdrijven dient justitie en media als een moment van polarisatie. Ze presenteren haar op een seksistische manier, met voortdurende verwijzingen naar haar relatie met een man en verwarring over de vraag waarom een vrouw deze weg zou inslaan. We zien dat achterdochtige vrouwen ofwel vermannelijkt ofwel pathologisch voorgesteld worden, waarbij hun daden gezien worden als het resultaat van hun temperament of een emotioneel defect. In weer een ander geval zien we hoe een vrouw in de media wordt beschreven als een vrouwelijke verleider met alle attributen van dien, en aan de hand daarvan wordt gedemoniseerd. Anderzijds wordt zij in de ogen van meer linkse media afgeschilderd als een onschuldig "meisje". Ook dit beeld is schadelijk voor de groep beschuldigden en de beweging. De vrouw is ook in alle gevallen slechts de vriendin van iemand. In de loop van de hele controverse moeten we ernaar streven dieper in te gaan op het strafsysteem, dat het patriarchaat in zijn zuivere vorm reproduceert

Bovenop de massamedia en de staatspropaganda maken de nazi's ook van de gelegenheid van een verdeelde publieke opinie over de zaak gebruik om hun eigen propaganda te maken, als slachtoffers van de radicaal-linkse beweging. Zij verzonnen verschillende publicatiemethoden om de beschuldigden uit te schakelen en op te roepen tot fascistische tegenaanvallen op ons. Ze verkregen informatie van agenten en gebruikten hun gesloten en open propagandakanalen om zoveel mogelijk details te verspreiden, specifiek gericht tegen de beschuldigden en degenen in hun omgeving.

In de ogen van de staat, de mainstream media en de politie zijn wij misdadigers en vijanden, vanwege onze ideeën over vrijheid en onze praktijken in het bestrijden van het systeem. We moeten hun definities niet volgen, maar samen staan tegen hun onderdrukking.

Conclusie

Maar wat zou staatsrepressie zijn zonder haar functionarissen? Voorlopig is de zaak in handen van de federale procureur, een politieke instelling en keuze die de politieke uitbreidingen en implicaties van dit proces blootlegt. Daarom hoeven we niets te verwachten van de procedure in de rechtszaal. Een emancipatorische strijd moet op straat worden geleverd, door druk uit te oefenen en politieke kosten te maken voor hun beslissingen. Terwijl de staat aanklachten creëert en relaties opbouwt om het antifascisme te bestrijden, is onze plaats op straat, waar we moeten proberen isolement en angst te doorbreken door nieuwe relaties en connecties te creëren. Dit is de plaats waar we deze onderdrukking werkelijk kunnen bestrijden en onze strijd sociaal kunnen legitimeren.

Onderdrukking is deel van onze strijd en we moeten die samen het hoofd bieden. In een systeem waar de problemen vragen om op een persoonlijke manier opgelost te worden, stellen wij collectieve oplossingen voor. Daarom roepen we iedereen op om solidair te zijn met de aangeklaagden, en dus aanwezig te zijn op de eerste dag van de rechtszaak op 8 september in Dresden. Laten we samen staan en laten zien dat een aanval op één van ons een aanval is op ons allemaal. Wij zijn hier, uit solidariteit met de aangeklaagden, tegen de repressie, en ter ondersteuning van het militante antifascisme dat verder gaat dan het aanvallen van nazi's en het systeem infiltreert met onze ideeën van vrijheid, non-hiërarchie en onderlinge zelforganisatie.
