In juli deed het Hof eindelijk uitspraak in de Barchem-4 zaak. De 'Barchem 4' verdachten worden verdacht van het bevrijden van 5,000 nertsen van een nertsenfokkerij in Barchem in 2009. Vier verdachten werden gearresteerd, waarbij huiszoekingen plaatsvonden en spullen in beslag werden genomen.

Net als in eerste aanleg vroeg de verdediging om vrijspraak. Dit vanwege disproportioneel gebruik van opsporingsmethodes, het achterhouden van belangrijke documenten hierover en het gebruik van anonieme getuigen.

De Advocaat-Generaal (AG) kwam in deze zaak verrassend uit de hoek. Terwijl de Officier van Justitie (OvJ) in eerste aanleg nog 15 maanden celstraf eiste, bood de AG in hoger beroep zijn excuses aan voor de fouten die in de zaak gemaakt zijn en het feit dat het al jaren duurt. (Het gaat om feiten uit 2009.) Hij eiste daarom slechts een week voorwaardelijke celstraf, met een proeftijd van één jaar. Dit staat in groot contrast met de manier waarop de activisten behandeld zijn vlak na de arrestatie. Zo hebben drie van de vier activisten 4 weken tot 3 maanden in voorarrest gezeten, waarvan gedeeltelijk zelfs in isolatie.

Het Hof ging uiteindelijk met de AG mee en legde een week voorwaardelijk op, met een proeftijd van een jaar. Dit betekent de activisten alle vier schuldig zijn bevonden aan vernieling en het bevrijden van 5000 nertsen in 2009. Ze hoeven hiervoor echter niet terug de cel in. Het bestaan van een criminele organisatie kon in eerste aanleg al niet worden bewezen.

Twee van de vier Barchem-4 activisten zullen binnenkort aan Engeland worden uitgeleverd. Ze worden daar verdacht van 'conspiracy to blackmail', dat vrijelijk wordt vertaald naar deelneming aan een criminele organisatie. In July the sentence of appeal in the Barchem 4 case was announced in Den Haag, The Netherlands. On a night in late October 2009, an incident occured at a mink fur farm in Barchem (East-Holland), resulting in the release of 5,000 mink, most of which were never re-captured. The Dutch police subsequently arrested four people who were accused of releasing the mink from the farm. The police proceeded to raid three apartments, taking all computers, digital devices, shoes, and various other items.

As in the first trial, the lawyers asked for a total acquittal of the case, due to disproportional investigation and surveillance methods, withholding of investigation files and anonymous individuals used as key witnesses. In opposition to the first trial though, in which the lead investigating prosecutor asked for 15 months in prison for all of the four defendants, this time, a new prosecutor publicly apologized, already during the court-hearing, for the unreasonable investigation methods of his colleagues.

His demand of one week of imprisonment, on probation for one year, was utterly funny, in contrast with the way the four defendants were treated just after the arrest. Three of the defendants were kept in pre trial custody for 4 weeks to 3 months, some of which in total isolation, in 2009/2010.

This means that three of the four defendants already did way more prison time than what was now given.

After the hearings, the judge gave exactly the asked sentence: one week of imprisonment and one year of probation time as all four defendants were found guilty of liberating 5000 minks and of the destruction of the farm perimeter. This means none of the activists will have to spend more prison time.

Already in the first trial the prosecution could not find any evidence supporting the theory of the existence of a criminal organization, so this part was totally acquitted.
