Judge suspends disputed building permit for BIBOB house The Amsterdam judicial court has, in a verdict dated 7 march 2008, and following complaints from residents and neighbours of the house Pretoriusstraat 28 in Amsterdam, suspended the building permit for this house on architechtonic/constructive grounds. The property is the subject of a mortgage-fraud court case and BIBOB procedures. The building permit for this house had already been withdrawn in january 2006, on the grounds of the law BIBOB. The owner at that time, J.C. McCarthy, has in the meantime been put on trial because of mortgage fraud with (amongst various properties) the house Pretoriusstraat 28. According to the dossier of the prosecution he made frequent use of front-men constructions. Following the arrest of McCarthy and the withdrawal of the building permit the mortage bank decided to sell the house in auction. The house was however pulled from the auction and sold privately to the current owners. The municipality commissioned BIBOB research into the new owners - just like the old owner - following information from the residents in which it was demonstrated that all kinds of links existed between McCarthy and the new owners. There was concern that there could once again be a situation in which front-men were being used. This research has, however, for the time being not yet led to the withdrawal of the building permit by the municipality. Resident of the house P. Modern is happy with the verdict, but still not placated. "This is a success, but we hope that the court case against McCarthy will give more clarity regarding the interwovenness of the business relationships with the current owners, because the current owners have - for the time being - evaded BIBOB measures." The mortage-fraud court case against McCarthy and more than 10 co-suspects takes place on the 14th, 15th and 16th april 2008 at the Amsterdam judicial courts.
