Call for public control of disposal billions

A spokesman for the Gorleben nuclear opponents has called for 30 billion euros set aside by German atomic power companies for dismantling and disposal to be put under public control. Francis Althoff of the Lüchow-Dannenberg Environment Protection Civic Initiative (BI) writes that the utilities Eon, RWE, EnBW and Vattenfall are using the untaxed reserves to expand their power by buying into other industries although it is clearly laid down that the money is supposed to be kept for dismantling nukes and disposing of waste.

“Should these private enterprises go bankrupt, the taxpayers will have to pay the extremely high costs of the unsolved issues of dealing with their radioactive leftovers,” Althoff argues.

Commenting on a ruling by the European Court (case T-92/02) that the German atomic power producers can continue to set aside the reserves for disposal costs tax-free, the BI called for a public political debate on the issue.

In March 2002, the town-owned utility companies Stadtwerke Schwäbisch Hall GmbH, Stadtwerke Tübingen GmbH, Stadtwerke Uelzen GmbH and Wuppertaler Stadtwerke AG filed an action in the European court against the European Commission challenging the tax privileges of the nuclear operators.

The applicants argued that German commercial and tax laws place the operators of nuclear power plants at an advantage since they are able to include large amounts of the costs of the later shutdown of the nuclear power plants and of the disposal of radioactive waste in their provisions.

The applicants claimed that, as a result, the profit actually realised by such operators is reduced by the sum of the reserves, thus exempting them to a considerable extent from the liability to pay income tax. The operators are able to dispose freely of the sums included in the reserves. The applicants, however, do not enjoy such an advantage. They see this as a distortion of competition.

The European court has dismissed the case, ruling that the tax breaks do not constitute state aid.

The BI demands that the interest and tax-free more than 30 billion euros be placed in a publicly controlled fund. In the nuclear consensus of 2000, writes Althoff, the chance of public control had been carelessly frittered away in favour of the atomic power industry.

“The federal government in 2002 also torpedoed EU plans for a Europe-wide publicly controlled fund. The constantly renewed demands to extend the running times of the nuclear power stations would also mean a lucrative extension and increase of the misused reserves. In Sweden nuclear power operators already have to pay into a public fund.

“Worldwide no final repository is in sight for highly radioactive waste which has to be safely separated from the biosphere for a billion years.

“It is simply evil that poisoning the environment is lucratively rewarded with tax concessions while alternative energy producers and small public works stay disadvantaged as competitors,” BI spokesman Althoff sums up.

BI: Atommüll-Milliarden in öffentlich-rechtlichen Fond
Urteil des Europäischen Gerichtshofs sichert Machtposition der
Atomstromer

Die Bürgerinitiative Umweltschutz Lüchow Dannenberg (BI) fordert
nach der Entscheidung des Europäischen Gerichtshofs (Az. T-92/02),
dass deutsche AKW-Betreiber weiterhin steuerfrei Rückstellungen für
Entsorgungskosten bilden können, eine öffentliche politische Debatte.
Die Stadtwerke Uelzen, Schwäbisch-Hall und Tübingen haben
erstinstanzlich erfolglos gegen eine Wettbewerbsverzerrung und
Bevorteilung der Atomstromer geklagt.

"Die Atommüller Eon, RWE, EnBW und Vattenfall erweitern mit den
steuerfreien Milliarden seit Jahren ihre Machtpositionen durch
Einkäufe in andere Industriezweige, obwohl klar definiert ist, dass die
Gelder für den Rückbau von Atommeilern und die
Atommüllentsorgung zur Verfügung stehen sollen. Wenn diese
privatwirtschaftlichen Unternehmen in Konkurs geraten, wird der
Steuerzahler für die extrem hohen Kosten des ungeklärten Umgangs
mit ihren strahlenden Hinterlassenschaften herangezogen", warnt der
BI-Sprecher

Die BI fordert die Überführung der zins- und steuerfreien über 30
Milliarden Euro in einen öffentlich-rechtlichen Fond. In der
Atomkonsens-Vereinbarung aus dem Jahr 2000 sei eine öffentlich-
rechtliche Regelung leichtfertig zugunsten der Atomindustrie
vertändelt worden. Auch Pläne der EU, für einen europaweiten
öffentlich-rechtlichen Fond, wurden von der Bundesregierung 2002
torpediert. Die immer wieder geäußerten Forderungen nach
Laufzeitverlängerungen der Atommeiler würden auch eine lukrative
Verlängerung und Erhöhung der unsachgemäß eingesetzten
Rückstellungen bedeuten.
In Schweden müssen die AKW-Betreiber bereits in einen öffentlichen
Topf einzahlen. Weltweit ist kein Endlager für hochradioaktiven Müll in
Sicht, der mindestens eine Milliarde Jahre sicher vor der Biosphäre
abgeschirmt werden muss. "Es ist eine Sauerei, dass die
Verseuchung der Umwelt durch Steuerfreiheit lukrativ belohnt wird,
während alternative Energieträger und kleinere Stadtwerke
gleichzeitig im Wettbewerb benachteiligt bleiben", fasst der BI-
Sprecher zusammen.
