Israelische aanklager zegt dat de Israelische settlers geen recht op hun nederzettingen in Gaza, Judea en Samaria hebben. Dat wist de rest van de wereld al lang, maar fijn dat ze het zelf ook even zeggen. "According to the state, "The area of Judea and Samaria and the area of the Gaza region are held by Israel under `combative takeover,' which is necessarily limited in time. The status of the Israeli communities established in these areas derives from the status of the territory, which is held under `combative takeover.'" The state's response, drafted by attorneys Osnat Mandel and Yuval Roitman, claims: "When the settlers settled in the Gaza Strip and northern Samaria, they did so knowing they were settling on territory held by the state under combative takeover. They were aware the Israel Defense Forces is sovereign over the area, and that all contacts regarding their routine life were conducted in accordance with it. The status of the territory, and the status of the Israeli communities within it obligated the settlers to anticipate the possibility of their evacuation someday." The state contends that since the government permitted settlement in the areas under combative takeover, it may also decide to end it, "when this stems from political and security motives." The state says that the land agreements each settler family signed with the Custodian of Government Property and Absentee Property, which leased land to settlers for erecting their homes, "include clauses that permit cancellation of the agreements." The state even adds it is authorized to decide not only to evacuate territories with "combative takeover" status, but also territories to which Israeli law applies." |
