from the dictatorship who its still imprisoned by "democracy."



Luis Rodrigo Morales Salas, who is 43 years old, is a political prisoner
from the dictatorship who its still imprisoned by "democracy." He has
been imprisoned October 30, 1999 and has been in the High Security Prison
(CAS) since the beginning of May 2002, after the end of the hunger strike
of political prisoners in CAS.

In January 2000, Morales requested a "presidential pardon" with the
support of the Committee of the Rights of the People (CODEPU) but then
President Eduardo Frei did not give it. The current President, Ricardo
Lagos, until now has not pardoned or even responded to the letters sent by
the Morales family to the presidential office which they have been doing
for two years.

The means of communication have silent about his case. Many of the human
rights groups and political parties have also been silent, with the
exception of The Organization of Rights of the People (ODEP) and the
Center of Mental Health and Huammn Rights (CINTRAS) who have been
campaigning for his liberty.

Rodrigo suffers today the neglect and scorn of human rights groups and
political groups like the Chilean Commission of Huamn Rights, CODEJU, AFDD,
AFEP, ANEPP, FASIC, the American Association of Jurists, the National
Assembly for Human Rights, the Manuel Rodriguez Patriotic Movement, the
Communist Party and the Humanist Party who were informed from the beginning
of his situation and until now have not expressed their solidarity nor have
they begun any campaign in his favor.

Rodrigo Morales was detained in June 1990, accused of being "head of the
Southeast Zone of the Manuel Roriguez Patriotic Front (FPMR) and of
having participated in 1987 in the kidnapping of
Army coronel Carlos Carreno,...among other charges. He was tortured by
the police of DIPOLCAR who interrogated him.

The "Carreno Case" was brought before the Military Court to investigate the
kidnapping, but charges were broadened to include infractions to the
Anti-Terrorist Law and the Law of Arms Control. The military prosecutor
demanded he be sentenced to 26 years in prison....The sentence was reduced
to 15 years, one day, as he was absolved of the charge of "illicit
association."

He was then put on trial a second time for infraction of the Anti-Terrorist
Law and the Law of Arms Control, judging him twice for the same
crimes....The judge designated was Sergio Valenzuela Patino, father of an
ex-agent of the CNI secret police, who sentenced Morales to four terms of
541 days each for: "illegal carrying weapons", "illegal possession of
weapons", "posession of explosives" and "the transport of explosives".
Nonetheless, despite the anger of the military, he was absolved a second
time of "illicit association."

......In March 19, 1994 Rodrigo Morales escaped from the prison on Santo
Domingo Street, in the middle of Santiago....On october 30, 1999 he was
arrested again by the police as he walked with his 10 year old son on
Amierco Vespucci and Presidentes streets. Rodrigo Salvaodr, his son was
interrrogated by the police for 4 hours about the subversive activities of
his father which caused the son a nervous conditon which later had to be
treated by the professional staff of CINTRAS.

Maria Salas Moraga, mother of Rodrigo, states: "I'm tired of writing to
the President, to his wife, to the Minister of Justice, ever since
November 2000 for the last two years, and except for small notes they have
not answered why they do not pardon my son, in spite of him being a
political prisoner from the time of the dictatorship. I have asked for an
audience with President Lagos, but nothing. ...I was informed that in
November 2009 my son can request parole...

Rodrigo Morales was imprisoned two more years in the Pentitenciary of
Santiago, together with drug dealers and crooks, as he was then not
considered a "subversive prisoner" like the prisoners in the High Security
Prison (CAS).

Today, however, Rodrigo Morales is in the High Security Prison (CAS) with
other political prisoners...Viveka Inostruza, his companera, says: "The
treatment in the High Security Prison is better than in the Pentitenciary.
Today, Rodrigo is with his companeros, but it is irrational that they don't
allow more visits.....His lawyers,... except for some small legal
procedures have not exerted
all their effort to achieve his freedom. The human rights groups have also
refused help. The Communist Party...is not interested......"

Rodrigo Morales states: "I am a political prisoner from the time of the
dictatorship and as such I am entitled to a presidential pardon under the
Law. The Coalition government (Concertacion) on taking office, agreed to
free all the political prisoners from the dictatorship. It has not done
so...Many are still imprisoned after 10 years without having been
sentenced, with double trials, and charged in military courts, which as
civilians should not have jurisdiction. The government has not changed
the laws instituted by the dictatorship that permit the military to judge
civilians. ...It is not logical that I have sentenced for supposed
crimes...which were legimate actions against the dictatorship of Augusto
Pinochet.....

Pardon is an alternative but the government prefers to hide. I am not
implicated in what the Coaltion government _Concedrtacion) calls "acts of
blood" ....Father Alfonso Baeza of the Social Pastorate, Human Rights
Watch, Amnesty International are aware of my situation....."

Rodrigo is not the only prisoner from the dictatorship who has been
neglected and scorned by the human rights groups and the government.
Abraham Larrea Zamorano and Jorge Espinola are still imprisoned for
actions that took place during the dictatorship without receivng pardons.
Roberto Bastias and Sergio Olivares Vasquez are also still imprisoned,
condemned by military and naval courts during the dictatorship., without
having received a pardon.....

Overheid hield rapport over vermisten achter.

SANTIAGO, 23 augustus 2002 - Zeven jaar lang hield de forensische dienst van het Chileense ministerie van Justitie een rapport achter over de identificatie van vermiste slachtoffers van het Pinochet-regime. Uit het rapport blijkt bijzonder veel twijfel over de identificatie van een drietal vermisten. De stoffelijke overschotten van de twijfelgevallen werden toch teruggeven aan de nabestaanden en opnieuw begraven. De verontwaardiging bij de Chileense publieke opinie en de nabestaanden is erg groot.

Het rapport dat nu boven water is gekomen, is van de hand van dokter Peter Vanezis van de Universiteit van Glasgow. Op vraag van de Chileense Legal Medical Service (SML) vergeleken hij en zijn team in 1995 genetisch materiaal van 27 anonieme Chileense lijken en hun mogelijke verwanten. Het ging om vermoedelijke slachtoffers van de dictatuur van generaal Augusto Pinochet van 1973 tot 1990, die op de hoofdbegraafplaats van Santiago in naamloze graven gedumpt waren en in 1991 opgegraven werden. Vanezis slaagde erin 24 slachtoffers te identificeren, maar in drie gevallen was er teveel twijfel. Patricia Hernandez, toenmalige directrice van de 'Eenheid voor de Identificatie van Gevangenen/Vermisten', veegde de twijfel van Vanezis onder tafel, en meldde daarover niets aan de bevoegde rechtbank. In 1995 werd de lichamen van de slachtoffers aan de families overgedragen en waardig begraven. Het bewuste rapport werd pas begin deze maand door dokter Salvatore Maísto, hoofd van de SML tot 1 augustus, aan openbare aanklager Mónica Maldonado overhandigd.

De verontwaardiging over de handelswijze van de SML is groot. Volgens Viviana Díaz, voorzitster van de Groep Van Families van de Verdwenen en Gevangen Slachtoffers (AFDD), is het vertrouwen bij de nabestaanden in de Chileense forensische dienst helemaal weg nu een aantal families niet langer zeker weten wat er met hun geliefden gebeurd is. De organisatie eist een diepgaand onderzoek met nieuwe genetische analyses. AFDD-activisten hadden ondertussen al een ontmoeting met minister van Justitie Jos Antonio Gómez, die een snelle hervorming van de Dienst voor Identificatie aankondigde.

AFDD-voorzitster Viviana Díaz noemt een herstructurering noodzakelijk, maar waarschuwt voor een overhaaste reactie. Eerst "dienen een aantal belangrijke aspecten te worden uitgewerkt, met inachtneming van een aantal voorstellen van de AFDD". De organisatie eist onder meer dat de Eenheid voor Identificatie zich enkel bezighoudt met overblijfselen van slachtoffers van schendingen van de mensenrechten, en niet met andere gevallen.

Ondertussen is een gerechtelijk onderzoek naar de zaak geopend, en heeft Hernandez ontslag genomen. Toch pleit zij onschuldig: het rapport uit Glasgow zou slechts een van vele elementen zijn die tot de identificatie hadden geleid. Verder was zij niet verplicht dat rapport aan de rechtbank over te maken; er werd haar trouwens nooit om gevraagd. Bovendien had zij wel degelijk mondeling verslag gedaan over de resultaten van het identificatieproces.

Hernández krijgt steun van vakbondsleider José Morales, voorzitter van de Vereniging van SML-ambtenaren. Volgens hem heeft Hernández haar werk altijd "op correcte wijze" uitgevoerd, en is het schandaal in scène gezet door twee voormalige SML-directeuren, Maísto en Jorge Rodríguez, die de SML in diskrediet willen brengen en zo de privatisering van de dienst willen afdwingen. Rodríguez zou in Nederland al materiaal gekocht hebben om een nieuw privé-laboratorium met de naam Gedesa uit te rusten.

Naar alle waarschijnlijkheid zal het Hof van Beroep van Santiago de SML op grond van belemmering van de rechtsgang vervolgen. Rechter Juan Pablo Droppelmann heeft alvast bevel gegeven de lichamen van de drie twijfelgevallen opnieuw op te graven. Verder wil hij de autopsieverslagen van alle opgegraven lichamen, en heeft hij dokter Vanezis opgeroepen als getuige.

Volgens een rapport van de Commissie voor Waarheid en Verzoening van april 1991 hebben de 'veiligheids'-diensten van Pinochet tijdens de dictatuur 3.190 politieke moorden bedreven. Bijna twaalfhonderd mensen zijn 'verdwenen'. De junta van Pinochet wierp in 1973 de democratisch verkozen regering van de socialistische president Salvador Allende omver. (IPS)
